The petitioner seeks bail in connection with Excise Case No. 137 of 2021 instituted for the offences under Section 30(a) of the Excise Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 18.06.2021, is a person with clean antecedent and prosecution report has been submitted in the case.
Learned counsel for the petitioner submits that the allegation is of recovery of 120 litres of liquor from a tempo. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.68353 of 2021(2) dt.25-02-2022 2/2 petitioner is neither the owner nor the driver of the tempo rather he was merely a passenger and as such was not knowing what was being carried in the tempo.
Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 18.06.2021, is a person with clean antecedent and prosecution report has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Excise Court, Saran at Chhapra in connection with Excise Case No. 137 of 2021.
