JUSTICE ANIL KUMAR SINHA ORAL ORDER 27-08-2019 The petitioner apprehends his arrest in connection with Pirpainti P. S. Case No. 153 of 2018 registered under Sections 307, 323, 341 and 506/34 of the Indian Penal Code. Allegation against the petitioner is that he along with other accused persons assaulted the informant by means of lathi, bhala etc.
Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case and both parties are neighbours. He submits that there is case and counter case in between the parties inasmuch as Pirpainti P.S.Case No. 152 of 2018 has been lodged by the side of the petitioner for the same incident and the injury caused to the informant and other is simple in nature as would be evident from the impugned order itself. .
After having heard learned counsel for the parties and
Patna High Court CR. MISC. No.53480 of 2019(2) dt.27-08-2019 2/2 taking into consideration the fact that both parties are neighbours and there is case and counter case in between the parties and there is admitted land dispute between the parties and the injuries caused to the informant and others are simple in nature, as such I am inclined to grant anticipatory bail to the petitioners.
Let the petitioner, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Bhagalpur in connection with Pirpainti P.S.Case No. 153 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
