The petitioner seeks bail in a case registered for the offence punishable under Sections 363/366(A)/34 of IPC. It is submitted that according to FIR lodged by the father of the victim, petitioner, Md. Rahmani, Safidhur Rahman and Md. Safibulhaque are the accused. Victim has been examined under Section 164 Cr.P.C. in which she has alleged that while she had gone to ease herself near the Basbari, Md Wali Rahmani and Md. Manzoor Ara tied her mouth and took her to the road where a motorcycle was standing and Md. Javed was also there. All the three tried to board her on the motorcycle but she raised alarm and in the meantime, some one flashed the torch thereafter all the accused fled away and she also returned to her house. It is also submitted that the victim has not named the
Patna High Court Cr.Misc. No.27660 of 2015 (2) dt.03-08-2015 2/2 petitioner in her statement under Section 164 Cr.P.C. It is further submitted that the petitioner has a criminal antecedent lodged by his wife under Section 498 A IPC.
Learned counsel for the State could not controvert the contention of the petitioner while opposing his prayer for bail. Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned S. D. J. M. (P), Sitamarhi/court concerned in Sursend P. S. Case No. 101 of 2015 with following conditions:-
1. The petitioner will not indulge himself in similar or any other offence.
2. One of the bailors must be the close relative of the petitioner.
3. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
