2. The order dated 29.11.2024 shall be treated as order no. 3 instead of order no. 2.

3. This is the 2nd attempt on behalf of the petitioner for regular bail in connection with Budha Colony P.S. Case No. 470 of 2022 registered for the offences punishable under Sections 401, 411, 414/34 of the IPC and under Sections 25(1-b) a/26 of the Arms Act.

4. Earlier the bail application of the petitioner was rejected by this Court vide Cr. Misc. No. 59700 of 2023 on 08.11.2023.

5. The order dated 08.11.2023 passed in Cr. Misc. No. 59700 of 2023 reads as follows:-

2. The petitioner is in custody since 22.09.2022 in connection with Budha Colony P.S. Case No. 470 of 2022 registered for the offence punishable under Sections 401/411/414/34 of the Indian Penal Code and Section 25(1-b) a/26 of the Arms Act.

3. As per the prosecution case, the petitioner who is accused in 27 serious cases for the offences committed in the district of Patna was caught by the police, one Webley Scott pistol, cartridges, huge amount of gold and mobile etc. have been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case merely on the basis of suspicion. He further submits that nothing incriminating has been recovered from the possession of the petitioner. He next submits that the petitioner has not been put on T.I.P.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail. He has submitted that from the records, it appears that the petitioner has committed crime in the town of Patna.

6. Considering the facts and circumstances of the case and also the allegations levelled against the petitioner, this application for grant of bail is dismissed.

7. The trial of all the cases registered against the petitioner are directed to be expedited.

8. Let a copy of the order be communicated to the Patna and also to the Senior Superintendent of Police, Patna through FAX/e-mail forthwith for compliance of the order."

6. The petitioner is accused in 44 more cases. He is in custody since 22.09.2022. Most of the cases are from the Patna

7. Considering the criminal antecedents of the petitioner, I am not inclined to grant bail to the petitioner.
