Case No. 56 of 2013 registered under section 364, 302 201, 120B/34 of the Indian Penal code and accordingly both the above stated petitions are being disposed of by this common order. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. According to prosecution case itself, none has seen the
Patna High Court Cr.Misc. No.27153 of 2014 (3) dt.12-01-2015 2/2 actual killing of the deceased and one Prabhunath Mahto and petitioner no. 1 of Cr. Misc. No. 3015 of 2014 made their statements before the villagers and on the basis of the aforesaid statements, the name of petitioners in Cr. Misc. No. 27153 of 2014 came in this case. Learned counsel for the petitioners points out that co-accused Prabhunath Mehto has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 16.06.2014 passed in Cr. Misc. No. 41789 of 2013. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with, Sahiara P.S.Case No. 56 of 2013.
