The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 408 of the Indian Penal Code.
Allegation against the petitioner is that while he was serving as Punchayat Secretary he did not distribute Ration Cards to the needy people.
Submission of the learned counsel for the petitioner is that most of the Ration Cards were distributed vide Annexure-2 series to the named person and none of the said person has complained regarding non-receipt of the Ration Card. In the meantime, the petitioner was transferred to some other place. Hence, some of the card could not be distributed.

No.24387 of 2017 (3) dt.01-07-2017 2/2 Considering the submission aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga/Successor Court in connection with Jalley Police Station Case No.168 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
