JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 20-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

Petitioner was apprehended while sitting over Hero Passion Pro motorcycle which, according to police was stolen one. It has been submitted on behalf of petitioner that he has been implicated on mere suspicion otherwise at least key of the motorcycle must have been recovered from his possession. Apart from this, petitioner is under custody since 20.06.2016 having clean antecedent. The Additional Public Prosecutor opposed the prayer. Accordingly, petitioner Kundan Kumar is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Nalanda in connection with Giriyak P.S. Case No.171 of 2016.
