2. The present petition has been preferred for the following relief/s:

(i) for issuance of writ in the nature of mandamus or any other appropriate writ/writs/order/orders/direction/directions directing the respondents to pay enhanced compensation amounting to Rs.40,000/- to the petitioner for his house which was taken for construction of Maharajganj-Mashrak Rail line situated in Khesra No. 3803, Plot no. 246, situated within the district of

Patna High Court CWJC No.11259 of 2014(3) dt.30-06-2025 2/2 Chapra.

3. Learned State Counsel has taken this Court to paragraph-10 of the counter affidavit filed on behalf of the Collector, Saran at Chapra to submit that the order of the learned Sub-Judge-II cum Special Court in (LAR) in LAR Case No. 42 of 2010 has already been complied and enhanced compensation amount has been paid vide cheque no. 022524 dated 06.02.2014.

4. From the counter affidavit, it is clear that the writ petition has become infructuous after enhanced payment, in view of the fact that the petitioner has chosen not to appear, the same is dismissed for non-prosecution.
