JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-09-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Nawada Twon P.S. Case no. 661 of 2016, registered under Sections 384 and 506/34 of the Indian Penal Code and Section 3 / 5 of Explosive Substance Act.

The accusation is that on 24.11.2016 at about 4.00 A.M. some miscreants came at the door of informant Santosh Kumar and hurled bomb and also dropped letter in the house making demand of ransom. Earlier, on 29.07.2016, 01.08.2016, 20.08.2016 and 17.11.2016, the informant had given information in this regard to the Officer-in-Charge Nawada Police Station, but no action was taken due to that reasons, they again hurled bomb at his door. Patna High Court Cr.Misc. No.25335 of 2017 (3) dt.07-09-2017 2/2 raised suspicion about conspiracy of Anant Kuwar @ Pintu, Manager of Guru construction.

Learned counsel for the petitioners submits that in respect of ancestral property the petitioners has filed the title suit in the court of Sub-Judge, Nawada, against informant which is pending for disposal, due to that reasons this false case has been lodged raising suspicion against the petitioners. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No. 661 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
