2. In this case, the petitioner is seeking regular bail in connection with Patna Excise P.S. Case No. 1714 of 2024, registered for the offences punishable under Sections 30(a) and 47 of the Bihar Prohibition and Excise (Amendment) Act, 2022.

3. As per allegation, on the basis of a secret information, the informant along with the police party reached the place of occurrence. Seeing the police party, the petitioner tried to flee away but was apprehended. On search, 67.28 litres of foreign liquor was recovered under the lemon tree, which is situated in front of the house of the petitioner.

4. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.61230 of 2024(2) dt.04-09-2024 2/2 that the petitioner is innocent and has falsely been implicated in this case. He is a person of clean antecedent. Nothing has been recovered from his conscious possession. His name has figured merely on the basis of suspicion. He is under custody since 21.07.2024.

Considering the above-mentioned facts and circumstances as well as clean antecedent, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise-3, Patna, DistrictPatna in connection with Patna Excise P.S. Case No. 1714 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
