JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 13-07-2017 Heard the counsel for the petitioner. Apprehending his arrest in Tariyani P.S. Case No. 18 of 2017 registered under section 302 IPC, the petitioner has filed the present application for grant of pre-arrest bail.

On going through the FIR, it is seen that specific allegation of having caused injury and pressing the neck of the deceased is attributed to the petitioner.

Counsel for the petitioner submits that both the parties belong to one family. The deceased was actually beaten in the school before. On going through impugned order, it appears that during investigation several witnesses have supported the accusation. The post mortem report is also discussed in the impugned order. Considering the gravity of the allegation and other materials reflecting from the records, prayer for anticipatory bail is rejected.
