The petitioners seek bail in Patepur P.S. Case No. 139 of 2012, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code and 27 of the Arms Act and Section 3 and 4 of Explosive Substances Act and 17 of the

Patna High Court Cr.Misc. No.28758 of 2015 (2) dt.06-08-2015 2/2 C.L.A. Act.

The informant alleged that 25-30 naxalites came and made indiscriminate firing in which her husband and son died. Petitioners are not named in the FIR. Nothing has been recovered from the possession of the petitioner. Name of the petitioner figured in the case in the confessional statement of Ravindra Sahni and Dilip Sahni. Except the confession the Investigating Officer did not collect any cogent and tangible evidence. Considering the facts aforesaid, the petitioners above named aew directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Patepur P.S. Case No. 139 of 2012.
