Petitioner seeks bail in a case registered for the offences punishable under Section 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act. This is a case of misuse of privilege of bail for three years in a case under Section 498A of the Indian Penal Code. Petitioner is in custody since 04.07.2019. He is aged about 65 years.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two

No.57148 of 2019(2) dt.12-09-2019 2/2 sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Complaint Case No.486 of 1999, subject to following condition:- (i) That both the bailors shall be resident of the territorial jurisdiction of the learned court below. (ii) That the petitioner shall not commit such misuse in future, otherwise it may give right to the court to conclude the trial after keeping the petitioner in custody.

(iii) That the petitioner shall fully co-operate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
