The petitioner is languishing in custody since 17.06.2016 in connection with Beldaur P.S. Case No. 25 of 2014 for the offences instituted under Sections 304(B) and 201/34 of the Indian Penal Code.

The prosecution story, in brief, is that there is allegation of demand of dowry and on non-fulfillment of the same subjecting to cruelty and killing the sister of the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.06.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of the witnesses alleged against the petitioner. In paragraph nos. 64 and

Patna High Court Cr.Misc. No.34884 of 2016 (3) dt.17-10-2016 2/2 65 of the case diary, statement under Section 164 of the Code of Criminal Procedure has been referred of the informant and the father of the deceased. It has been stated by them that due to mistake of fact the present case has been instituted. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (The Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate1st Class, Khagaria in connection with Beldaur P.S. Case No. 25 of 2014.
