JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,323,504 and 307 of the Indian Penal Code and section 27 of the Arms Act.

It is alleged that the informant Manu Kumar came at the door of Baidnath Sharma. All of a sudden, the petitioner and others armed with lathi assaulted Binod Singh, Sardar Paswan and Deomuni Singh whereas co accused Rajbans Ram fired from the gun causing injury to Bullu Ram.

It is submitted by the learned counsel for the petitioner that the accusation is omnibus and general and injury has been found to be simple and except Rajbans Ram who is alleged to

Patna High Court Cr.Misc. No.28455 of 2015 (2) dt.24-07-2015 2/2 have caused fire arm injury, others have been granted bail vide Cr. Misc. Nos. 42654, 42929 and 43815 of 2014. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the accusation being omnibus and general, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Sasaram, Rohtas in connection with Chenari P.S. Case No. 39 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
