2. The petitioner apprehends his arrest in a case registered for the offence under Sections 413, 414, 467, 468/34 of the Indian Penal Code.
3. According to F.I.R., the informant got a secret information that this petitioner alongwith other co-accused persons are cutting the stolen pick-up van for the purpose of selling it to scrapper, he alongwith other police officials reached there and apprehended co-accused Md. Salhin, who disclosed the name of this petitioner, as his one of the associates who fled away from spot.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. No
Patna High Court CR. MISC. No.60706 of 2024(2) dt.27-09-2024 2/2 incriminating article has been recovered from the possession of this petitioner and has been made accused in this case only on confession of co-accused, who was apprehended on spot. Similarly situated two co-accused persons have already been granted bail by this Court, vide order dated 10.08.2023 passed in Cr.Misc. No. 45410 of 2023. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Rosera, Samastipur in connection with Bithan P.S. Case No. 37 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
