JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was working in the concerned company and accusation against him is that he defalcated near about Rs. 32 lacs of the company.

Learned counsel for the petitioner submits that as a matter of fact, nothing was handed over to the petitioner and he has become prey of official politics. In course of investigation, two witnesses vide Para-42 and 47 of the case diary stated that some amount had been given to the petitioner but except the oral statement of witnesses, there is nothing on the record to show that any amount was ever handed over to the petitioner. Petitioner is in jail custody since 20.04.2015.

Patna High Court Cr.Misc. No.28043 of 2015 (3) dt.13-10-2015 2/2 Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Saharsa P.S.Case No. 294 of 2015.
