2. The petitioner apprehends his arrest in a case, registered for offence punishable under Sections 302, 201 and 34 of the Indian Penal Code.

As per F.I.R., on 22.07.2022 at about 07:00 AM, the informant, who is chaukidar, got secret information that one girl was murdered and her dead body was buried at Village Mahara Deur, whereupon informant and other police officers reached there and found that the body of the girl was buried and was dugged inside the soil. On inquiry, family members of the girl were found absconding.

4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. Name of the petitioner

Patna High Court CR. MISC. No.59908 of 2025(2) dt.15-10-2025 2/2 transpired only on the basis of suspicion. There is no eyewitness to the alleged occurrence. During course of investigation, none of the witnesses claimed to have seen this petitioner committing the murder of the deceased.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail and submits that petitioner is brother of the deceased. As a matter of fact, there was love affairs between deceased and one Durgesh Gond, which was opposed by the family members of the deceased and due to this reason this petitioner along with others committed murder of the deceased and buried her dead body with a view to conceal the evidence. He further submits that the post-mortem report in para 24 of the case diary shows that a circular black spot was found on the neck of the deceased. During course of investigation, petitioner and his family members were found absconding from the house and investigation is still going on.

6. Considering the aforesaid facts and circumstances, the prayer for anticipatory bail of petitioner is rejected. (Prabhat Kumar Singh, J) anay U T
