The petitioner apprehends his arrest in Bairiya P.S. Case No. 188 of 2021, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

17 litres of illicit liquor has been recovered from motorcycle of this petitioner.

It is submitted that petitioner has falsely been implicated in this case. Nothing has been recovered from conscious possession of this petitioner. The motorcycle in question does not belong to this petitioner. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner above-

Patna High Court CR. MISC. No.68152 of 2021(2) dt.25-05-2022 2/2 named in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Bettiah, West Champaran in connection with Bairiya P.S. Case No. 188 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
