JUSTICE SUDHIR SINGH ORAL ORDER 27-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 264, 265, 266, 379 of the Indian Penal Cod and Section 7 of E.C.Act.
The allegation against the petitioner is of short supply of petrol and diesel. It is further alleged that in presence of the villagers one litre of petrol was taken from the petrol pump and measured which was found to be 900 ml. The four nozzle of the petrol pump was seized.
On behalf of the petitioner, it has been submitted that the petitioner has got no criminal antecedent. It is further submitted that it is a case of mistake of fact. Same is evident from perusal of Annexure 6 to the supplementary affidavit, which
Patna High Court Cr.Misc. No.28834 of 2015 (2) dt.27-07-2015 2/2 indicates that there was no irregularity being committed by the petitioner.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Sheohar in connection with Tariyani P.S.case No. 36 of 2015, subject to the conditions as laid down u/s 438(2) Cr.P.C. (Sudhir Singh, J) singh/- U T
