2. The petitioner seeks bail in a case registered for offence under Sections 189(2), 191(2), 191(3), 126(2), 115(2), 61(2), 103(1) of the B.N.S., 2023.
3. The prosecution case, in brief, is that on 30.04.2025, the informant received a telephonic information that his son Nand Kumar was brutally assaulted and thrown near railway track situated at Raghopur Balat and thereafter, informant rushed to the place of occurrence where villagers informed that his son was taken to Rajnagar Hospital by police patrolling vehicle. Thereafter, informant again rushed to hospital and found his son in injured condition and on inquiry, his son disclosed the name of the assailants. Petitioner is one of them.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. As per prosecution case, 11 named including this petitioner and 20 unknown persons assaulted son of the informant, but in the postmortem report, only three injuries have been found on the person of deceased and thus, F.I.R. stands contradicted and falsified by the post-mortem report. Allegation is general and omnibus. Informant is not eye-witness to the occurrence and petitioner is in custody since 30.04.2025. Chargesheet has been submitted.
5. Learned A.P.P. for the State opposes the prayer for bail.
6. Considering the nature of accusation and period of custody, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhubani in connection with Rajnagar P.S. Case No. 169 of 2025.
