JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report with accusation that he along with co-accused, Vikash Kumar abducted the informant's minor daughter.

The victim has not been recovered as yet but it is admitted case of the prosecution that one year prior to the alleged occurrence, the victim was abducted by co-accused, Vikash Kumar for which Kazimohammadpur P.S. Case No. 305 of 2014 was registered against the co-accused, Vikash Kumar and his family members and in the aforesaid case, the statement of victim was recorded under Section 164 of the Cr.P.C.

Patna High Court Cr.Misc. No.30216 of 2015 (3) dt.27-10-2015 2/2 Learned counsel for the petitioner submits that petitioner has been made accused in this case on mere suspicion as he happens to be co-villager of co-accused, Vikash Kumar and moreover, petitioner is in jail custody since 02.03.2015 without any cogent material.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Kajimohammadpur P.S. Case No. 96 of 2015.
