JUSTICE SUDHIR SINGH ORAL ORDER 16-02-2022 Due to the third wave of COVID-19 Pandemic, the matter is being taken up by way of Virtual Court proceeding. The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioner and learned APP for the State through virtual mode.

Learned Counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks after restoration of normalcy. The petitioner seeks bail in a case registered under Sections 498A, 304B/34 of the Indian Penal Code. Later on, case has been converted under Sections 302, 498A/34 of I.P.C. Allegation is that the accused persons including the

It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.10.2017 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is alleged to be the husband of the deceased. There is no eye witness to the alleged occurrence. Earlier the case was instituted for an offence under Section 304B and other allied Sections of the I.P.C. Later on, the case was converted under Sections 302 and other allied Sections of the I.P.C.

A report was called for from the trial court. It has been reported that till date no prosecution witness has been examined in this case.

On behalf of the State, it is submitted that the petitioner is named in the complaint case/F.I.R. Considering the facts and circumstances, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge II, Jamui in connection with S.Tr.
