JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-06-2018 Petitioner apprehends his arrest in connection with Doriganj P.S.Case No. 124 of 2017 registered for the offences punishable under Sections 420 and 379/34 of the Indian Penal Code.

Allegation against the petitioner is that he along with other accused persons has withdrawn an amount of Rs.43,887/- from the account of the informant through ATM. Submission of learned counsel for the petitioner is that except suspicion that he has also gone with the informant there is nothing against the petitioner and one co-accused has been granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 15.12.2017 passed in Cr.Misc.No. 53269 of 2017. Heard learned APP also.

No.18035 of 2018 (3) dt.20-06-2018 2/2 Having heard both sides and in the facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra, in connection with Doriganj P.S.Case No. 124 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
