JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-02-2022 Heard learned counsel for the petitioner, the State and perused the trial court's report dated 10.12.2021. Earlier prayer for bail of the petitioner, who is the husband of the deceased, was rejected by this Court on 13.7.2021 (Annexure 1).
Learned counsel for the petitioner has filed supplementary affidavit wherein he has submitted that till date five prosecution witnesses including Dashrath Mahto (PW 4), the informant of the case have been examined and they have not supported the prosecution case. Remaining witnesses are the official witnesses and there is no likelihood of conclusion of the trial in the near future and petitioner is in custody since 19.11.2019.
Trial court's report dated 10.12.2021 reveals that the case is running for prosecution witnesses and for ensuring their appearance summons have already been issued on 6.12.2021. Considering the depositions of witnesses, progress of the trial and the custody of the petitioner, prayer for bail of the
Patna High Court CR. MISC. No.67867 of 2021(4) dt.16-02-2022 2/2 petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge XVII, Muzaffarpur in Gaighat Police Station Case No. 143 of 2019/ Sessions Trial No. 183 of 2021.
