Petitioner apprehends his arrest in connection with Ghoswari P.S. Case No. 47 of 2016, registered for the offences punishable under Sections 341, 323, 307, 325 and 34 of the Indian Penal Code.

Allegation against the petitioner and other accused persons is of committing Marpit at the petrol pump of the informant.

Submission of learned counsel for the petitioner is that the main allegation against other accused persons, who disclosed the name of the petitioner and, as such, he is named in the FIR and the injuries are simple in nature. Further submission is that petitioner was staff of petrol pump and his salary was due to the

Patna High Court Cr.Misc. No.23634 of 2018 (3) dt.09-05-2018 2/2 informant and he demanded the same, as such, he has falsely been implicated in this case and there is case and counter case between the parties.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IV, Barh, Patna, in connection with Ghoswari P.S. Case No. 47 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors shall be a local person having sufficient immovable properties within the jurisdiction of court concerned.
