ANJANA MISHRA ORAL ORDER 09-08-2017 Heard learned counsel for the petitioner and the learned counsel for Opposite Party No.2. Learned counsel for the State is also present.

Having granted repeated indulgences to the petitioner for making payment of residual amount, which had been directed by this Court on the earlier occasions, the petitioner has failed to do so. It is evident from such conduct that the petitioner is wholly recalcitrant and has no respect for the orders of this Court and as such, this Court does not feel inclined to entertain the present application for modification of the order dated 19.04.2017 passed in Cr.Misc. No.39796 of 2016. The present modification application is, accordingly, dismissed.

Patna High Court Cr.Misc. No.24750 of 2017 (4) dt.09-08-2017 2/2 If, however, the petitioner appears in the court below i.e., in the court of the learned Chief Judicial Magistrate, Darbhanga, in connection with Laheriasarai P.S. Case No.227 of 2015, on 20th of September, 2017 along with the amount as directed earlier, it shall be open to the court below to consider his case for regular bail on the same date.
