====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-09-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Rajauli P.S. Case No. 132 of 2016 registered under Section 47(a) of Bihar Excise (Amendment) Act, 2016.
Accusation is that two persons who were on motorcycle, started to flee away on seeing the police party. But on chase one of them was apprehended, who disclosed his name Rajiv Kumar. On search, 48 bottles, each containing 375 ML Indian made foreign liquor, 45 bottles, each containing 175 ML foreign liquor and 10 pouches, each containing 200 ML country made liquor, were recovered from his possession of Rajiv Kumar. He disclosed the name of the petitioner as his associates,
Patna High Court Cr.Misc. No.35201 of 2016 (2) dt.02-09-2016 2/2 succeeded to flee away.
Learned counsel appearing on behalf of the petitioner submits that co-accused Rajiv Kumar, from whose possession the aforesaid recovery of liquor is said to be made, has disclosed the name of this petitioner.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Nawada, in connection with Rajauli, P.S. Case No. 132 of 2016, subject to the conditions as laid down under Sections 438(2) of the Cr.P.C.
