The petitioner seeks bail in Sessions Trial No. 176 of 2021, arising out of Sahar P.S. Case No. 247 of 2020, registered for the offence under Section 302 / 120(B) of the Indian Penal Code.

As per the prosecution case, petitioner alongwith other F.I.R. named accused persons killed son of the informant by causing fire-arm injury. The informant raised suspicion that there was love affairs between Khushbu Kumari and Chullu Kumar, which the son of the informant used to protest. Petitioner is not named in the F.I.R. Name of the petitioner has transpired on the basis of confessional statement of co-accused Chullu Kumar @ Chullu Baba, who has already been granted bail, vide order dated 17.01.2022 passed in

Patna High Court CR. MISC. No.68676 of 2021(2) dt.03-03-2022 2/2 Cr.Misc. No. 34144 of 2021. It is submitted that other F.I.R. named accused persons have already been granted bail by this Court and petitioner is in custody since 13.06.2021. Learned counsel for the State and informant opposed the bail petition and submitted that during course of investigation, name of the petitioner has surfaced that he also participated in the aforesaid crime.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - XI, Bhojpur in connection with Sessions Trial No. 176 of 2021, arising out of Sahar P.S.
