2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 342, 323, 324, 307, 379, 504, 506, 325 and 34 of the Indian Penal Code.
3. The prosecution case, as per the First Information Report, is that on 16.07.2023, all the named accused persons, including this petitioner, assaulted son and nephew of informant with lathi, danda and rod.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Allegation of assault is general and omnibus and there is no specific accusation of assault against petitioner. It is further submitted that similarly situated co-accused persons have already been granted anticipatory bail by co-ordinate Bench of this Hon'ble
Patna High Court CR. MISC. No.57378 of 2025(2) dt.02-09-2025 2/2 Court vide order dated 03.12.2024 passed in Cr. Misc. No. 78801 of 2024. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Shambhuganj P. S. Case No. 179 of 2023, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) Navya/- U T
