JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-09-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Parsa Bazar P.S. Case no. 74 of 2017, registered under Sections 341, 323, 504 and 498(A)/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

The accusation is of torturing of the informant by her husband and other in-laws due to non-fulfillment of demand of cash of Rs. Eight Lakhs under different modes and removing her from matrimonial house snatching her personal belongings. Learned counsel for the petitioner submits that petitioner is still ready to keep his wife, O.P. No.2, with full dignity. Learned counsel for the O.P. No.2 submits that due to ill behaviour and harassment of the petitioner and his other family members to the O.P. No.2, she is not ready to lead her conjugal life and she has also filed a Divorce Case.

No.25947 of 2017 (3) dt.08-09-2017 2/2 Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-cum-C.B.I-II, Patna in connection with Parsa Bazar P.S. Case No. 74 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
