03-03-2022 Heard learned counsel for the parties.

Earlier, the bail petition of petitioner was rejected, vide order dated 04.10.2021 passed in Cr. Misc. No. 17096 of 2021 with following observation:

"Petitioner may renew prayer for bail after framing of the charges before the court below itself."

It is submitted on behalf of the petitioner that charge has already been framed on 25.06.2021. Petitioner is in custody since 15.09.2020 and there is no adequate progress in the trial. The Trial Court report also reveals that after framing of charge, only two witnesses have been examined and the case is pending for trial of rest of the witnesses. Considering the period of custody and stage of the trial, the bail petition of petitioner is allowed. Let the above

Patna High Court CR. MISC. No.68465 of 2021(3) dt.03-03-2022 2/2 named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Nalanda at Biharsharif in connection with Harnaut (Gokhulpur O.P) P.S. Case No. 466 of 2020.
