JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2017 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered under Section s 341, 323, 307 and 504/34 of the Indian Penal Code.

Allegation is that the accused persons including the petitioners assaulted the informant by means of lathi. When the wife and sister of the informant went to save him, they were also assaulted by them.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. It is a case and counter case between the parties.

Patna High Court Cr.Misc. No.28126 of 2017 (2) dt.06-07-2017 2/2 Specific allegation is against the co-accused, namely, Rajdeo Yadav. As far as the petitioners are concerned, general and omnibus allegation has been made.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Salaiya P.S. case No.17 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
