The petitioner apprehends his arrest in Jagdishpur P.S. Case No. 247 of 2021, registered for the offences punishable under Sections 379, 323 and other allied sections of the Indian Penal Code.

As per the prosecution case, this petitioner along with co-accused Vishal Kumar attempted to tease the informant and when she protested, the accused persons assaulted her. When husband of informant went at the house of accused persons, he was also assaulted by them. It is further alleged that petitioner broke the door of informant's house, entered and damaged household articles and took away cash of Rs. 1,30,000/- which was kept in the house for the purpose of marriage.

Petitioner has been falsely implicated in this case simply because he is friend of co-accused Vishal Kumar. As a matter of fact, goat of informant had gone in the field of petitioner upon which he scolded the daughter of informant and after two days of the occurrence this false case has been lodged against petitioner. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist Class, Bhojpur at Ara in connection with Jagdishpur P.S. Case No. 247 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
