2. The petitioner seeks regular bail in connection with Industrial P.S. Case No. 225 of 2024 registered for the offence under Section(s) 191(2), 191(3), 126(2), 115(2), 109, 308(2), 74, 352, 351(2) & 351(3) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the petitioner is accused of assaulting the informant.

4. Mr. Sinha, the learned Senior counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. Petitioner is in custody since 26.06.2025. He further submits that the occurrence took place

Patna High Court CR. MISC. No.60365 of 2025(6) dt.10-10-2025 2/3 because of the land dispute and the petitioner is ready to compensate the informant by paying Rs. 4.5 Lakh. The learned Senior Counsel for the petitioner has produced a cheque of Rs. 1,87,120 and a demand draft of Rs. 2,62,880/- in the name of the informant.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. I have heard and considered the submissions of the parties.

7. The demand draft of Rs. 2,62,880/- in the name of Md. Gulam Mustafa (informant) and a cheque of Rs. 1,87,120 is being handed over to the learned counsel for the informant.

8. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

9. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1, Bhagalpur/concerned Court below in connection with Industrial P.S. Case No. 225 of 2024 subject to conditions that:- (i). The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial

Patna High Court CR. MISC. No.60365 of 2025(6) dt.10-10-2025 3/3 shall result in cancellation of the bail bond of the petitioner.
