====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 10-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Narpatganj P.S. Case No. 326 of 2021 registered under Sections 399, 400, 402 and 414 of the Indian Penal Code read with Sections 25(1-b)a, 26 (i) (ii)/35 of the Arms Act. Learned counsel for the petitioner submits that petitioner is in custody since 14.07.2021, is a person with clean antecedent, charge-sheet has been submitted in the case and allegation is recovery of one country made pistol alongwith one live cartridge, mobile from the possession of the petitioner. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, further all the named accused persons have been released on bail and petitioner is a person with clean antecedent and even presuming

Patna High Court CR. MISC. No.68040 of 2021(2) dt.10-05-2022 2/2 what has been alleged is true without admitting for the purposes of bail that the thrust of the allegation under the Arms Act and this is the first offence of the petitioner.

The learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 14.07.2021, is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Narpatganj P.S. Case No. 326 of 2021 with a condition that one of the bailors shall be the father of the petitioner namely Umesh Paswan.
