Petitioner is not named in the first information report but in course of investigation, the name of petitioner came on the basis of call detail report of his mobile and the co-accused in his confessional statement claimed that the killers of the deceased were hired by the petitioner and it was petitioner, who got eliminated the deceased through hired killers due to business rivalry.

Contention on behalf of the petitioner is that coaccused Ravi Sahni in whose statement the name of petitioner

Patna High Court Cr.Misc. No.37258 of 2016 (2) dt.06-09-2016 2/2 surfaced in this case, has already been granted privilege of bail and, similarly, co-accused Ranjan Sahni, against whom there is allegation of taking active part in the alleged crime, has also been granted privilege of bail and so far as petitioner is concerned, except suspicion as well as so called confessional statement of coaccused, there is nothing against him. Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact the investigation against the petitioner has already been completed, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Chhatauni P.S.Case No. 69 of 2015.
