2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 447, 341, 323, 324, 307, 379, 504 and 34 of the Indian Penal Code.

3. As per allegation in the FIR, petitioner along with his entire family has assaulted the informant and his wife. Specific allegation against the petitioner is of assaulting them by means of Bhujali causing injury to informant at left side of back and his wife received injury upon her right arm.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Both parties are distant agnate and neighbour. They are on inimical

Patna High Court CR. MISC. No.59362 of 2023(2) dt.04-09-2023 2/2 term due to land dispute. Injured have received injury on nonvital organ and doctor opined nature of injury as simple in nature. Petitioner is languishing in judicial custody since 12.4.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Gopalganj in connection with Gopalganj Town P.S. Case No. 446 of 2017.
