====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 10-09-2025 Heard Mr. Dhannjay Kumar II, learned counsel appearing on behalf of the petitioner and Mr. Ajay Kumar Jha, learned APP for the State.
2. The petitioner seeks pre-arrest bail in connection with Sahebganj P.S. Case No. 35/2023 registered for the offence punishable under Section 414 of the Indian Penal Code and Sections 20(b)(ii)(c) and 22 of the NDPS Act.
3. Considering the nature of allegation made in the F.I.R., as well as, the fact that the petitioner's name has surfaced in the present case on the basis of confessional statement of the co-accused namely Pramod Kumar and Majnu Patel who are driver and helper of the truck from which huge quantity of ganja was recovered and the quantity of the ganja was more than that of the permissible limit, I am not inclined to enlarge the
Patna High Court CR. MISC. No.61568 of 2025(2) dt.10-09-2025 2/2 petitioner on pre-arrest bail.
4. The petitioner, if so advised, may seek regular bail before the learned District Court. The learned District Court is directed to pass a necessary order, in accordance with law, on the basis of materials available on record, on the same day, the bail application is filed, without any further delay and without being prejudiced by any observation made by this Court.
5. Accordingly, the present bail application stands disposed of.
