The petitioner apprehends his arrest in connection with Sakra P. S. Case No. 300 of 2016 instituted under Sections 409 and 420/34 of the Indian Penal Code.

Allegation, as per the Programme Officer, is that under the financial year 2011-12, without doing plantation money was withdrawn by these petitioners in connivance with other accused and misappropriated the Government money. Learned counsel for the petitioner submits that the petitioner is a Junior Engineer under Manrega Scheme and doing plantation was not his responsibility and this case was lodged after four years.

The allegation is very specific against this petitioner

Patna High Court Cr.Misc. No.30420 of 2017 (2) dt.06-07-2017 2/2 and it appears that after conducting preliminary enquiry by the concerned Department, the FIR was lodged by the Programme Officer against this petitioner, so prayer for anticipatory bail is refused.

However, if the petitioner surrenders in the court below and seeks regular bail, the same shall be considered on its own merit without being prejudiced by this order. (Arun Kumar, J) Sujit/- U
