The petitioner apprehends his arrest in connection with Ahiyapur P.S. Case No. 669 of 2019, registered under Sections 356 and 379 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. rather on the basis of written report of informant, Ahiyapur P.S. Case No. 669 of 2019 was instituted against two unknown, disclosing that two unknown persons, who were sitting on Yamaha FZ BR06BR-3074, snatched his mobile and gold chain. Thereafter, in course of investigation, police seized the aforesaid motorcycle engaged in committing the loot from the house of Kundan Kumar, who also

Patna High Court CR. MISC. No.54115 of 2019(2) dt.28-08-2019 2/2 disclosed that the said motorcycle was taken by Vishal Kumar and this petitioner for some urgent work, except that nothing has been collected by the investigating Officer, showing the involvement of the petitioner in the present crime. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur P.S. Case No. 669 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
