JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-02-2015 Heard learned counsels for the petitioner and the State. The petitioner being husband of the complainant is apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act. Notices were issued to O.P. No. 2 vide order dated 10.7.2014 but inspite of valid service of notice, none is appearing on behalf of O.P. No. 2.

Considering the statement made in paragraph nos. 8 and 12 that petitioner is ready to keep the complainant and has not performed second marriage, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender

Patna High Court Cr.Misc. No.28310 of 2014 (4) dt.05-02-2015 2/2 before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Khagaria in connection with Complaint Case No. 967 C of 2012 subject to the conditions as laid down under Section 438(2) Cr.P.C.

In case the complainant files an application for resuming the conjugal life, the petitioner will be obliged to take her to keep her as wife with due dignity and honour. (Dinesh Kumar Singh, J) Anil/- U T
