JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 12.3.2014 in a case registered for the offences punishable under Section 420 of the Indian Penal Code.
It is alleged that the petitioner being the Chief Executive Officer of Dinanath Ricksha, Thela Chalak Co-Operative Society, Patna used to give/take loans to/from the non members of the Society against the provisions of the bye-laws. It is submitted by the learned counsel for the petitioner that none have claimed that the petitioner actually cheated any body. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named
Patna High Court Cr.Misc. No.33330 of 2014 (4) dt.12-01-2015 2/2 petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Patna in connection with Budha Colony P.S. Case No. 78 of 2014.
