The petitioner apprehends her arrest in Dariyapur P.S. Case No. 16/2017, registered for the offences punishable under Section 304B of the Indian Penal Code.
The informant alleged that he married his daughter in the year 2013 with Shyam Kumar Sharma son of Gautam Sharma in the village Bela Sharma Tola. On 22.01.2017, the informant got information that something untoward happened to his daughter. When the informant went to the house of his daughter, her deadbody was lying on a cot. He further alleged that accused persons were demanding additional dowry immediately after marriage. Learned counsel for the petitioner submits that petitioner is mother-in-law of the deceased. Within four years of
Patna High Court Cr.Misc. No.13770 of 2017 (3) dt.24-05-2017 2/2 marriage, the deceased never complained about any ill-treatment at the hands of the petitioner. It is submitted that the deceased committed suicide on account of dispute with her husband. In the post-mortem report the ligature mark was found all around the neck. No other injuries were found on the person of the deceased. During the course investigation, the witnesses have stated that the deceased committed suicide by hanging herself.
Considering the facts aforesaid and the fact that petitioner is mother-in-law of the deceased and no specific allegation is made against the petitioner, the petitioner abovenamed, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Dariyapur P.S. Case No. 16/2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.)
