JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under section 366 of the Indian Penal Code.

The accusation is of kidnapping the daughter of the informant.

It is submitted by learned counsel for the petitioner that the victim married with the petitioner but when she returned home, a tutored 164 Cr.P.C. statement was recorded. During medical examination, no sign of rape was found and the victim was found to be aged 19 years.

Considering the fact that the victim in her 164 Cr.P.C.

Patna High Court Cr.Misc. No.28460 of 2015 (2) dt.24-07-2015 2/2 statement stated that she was kidnapped and ravished by the petitioner and co accused Chandan Sah, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Jaynagar P.S. Case No. 54 of 2014 pending in the court of learned S.D.J.M., Madhubani.

This application is disposed of with the aforesaid observation/direction.
