The petitioners, namely, Jitendra Singh, Dhuri Singh, Dharmsheela Devi and Urehan Devi, apprehend their arrest in Karpi P.S. Case No. 44 of 2016 registered under Sections 302, 201, 120(B) of the Indian Penal Code.
Vinod Singh, the informant, alleged that his daughter was married to Arbind Kumar in the year 2004 and she went to her Sasural. After 2-3 years, the in-laws of his daughter began to demand Rs. 50,000/-. The informant further alleged that his son gave Rs. 75,000/- to the family members of his sister. It is alleged that all the accused persons burnt his daughter to death on 17.03.2016.
Learned counsel for the petitioners submits that the
Patna High Court Cr.Misc. No.36345 of 2016 (3) dt.20-10-2016 2/2 petitioners are brothers-in-law, sister-in-law and mothers-in-law of the deceased. The marriage was solemnized 12 years ago. During the period of 12 years, neither any application has been made nor has the informant complained about the ill-treatment of the deceased at the hands petitioner for demand of dowry and torture. It has been submitted that the deceased was living with her husband and the petitioners have no manner of concern with the deceased or her husband.
Considering the facts that the petitioners are in-laws of the deceased and the deceased died after 12 years of her marriage, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal in Karpi P.S. Case No. 44/2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
