JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-11-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 394, 302, 307/ of the Indian Penal Code and 27 of Arms Act.

Petitioner is not named in the first information report but from perusal of the case diary, I find that the name of petitioner came in confessional statement of co-accused Md. Safiullah Sah @ Safiullah and except the above stated confessional statement of co-accused as well as criminal antecedents of the petitioner, there appears to be nothing against him. Petitioner is in jail custody since 2.2.2019 and, admittedly, co-accused Md. Safiullah Sah @ Safiullah has already been

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st, Jhanjharpur in connection with Jhanjharpur (Araria Sangram) P.S. Case No. 106/2018.
