The petitioner apprehends his arrest in Hussainganj P.S. Case No. 82 of 2021 registered for the offence under Section 341, 323, 324, 147, 148, 149, 307, 379, 504 of the Indian Penal Code.

As per the prosecution case this petitioner alongwith co-accused Shailendra Yadav are alleged to have assaulted Sipahi Yadav and Suryanath Yadav by Lathi who came to rescue the informant.

It is submitted on behalf of petitioner that the present case is counter blast of Hussainganj P.S. Case No. 61 of 2021 which was filed by the petitioner against the informant and others in which petitioner's side also sustained injury. He further submits that there is land dispute for path between the parties

Patna High Court CR. MISC. No.67770 of 2021(2) dt.25-05-2022 2/2 and due to that the false case has been instituted and petitioner has clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IX, Siwan in connection with Hussanganj P.S. Case No. 82 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
