JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and 11 persons are named in the first information report with allegation that they made indiscriminate firing causing death of two persons.

The post-mortem reports of the deceased persons go to show that one deceased sustained one firearm injury and another deceased sustained two firearm injuries. In course of investigation, some witnesses did not name the petitioner. Moreover, having more or less similar allegation, co-accused Naresh Yadav and Shravan Yadav have already been granted privilege of regular bail and Lalit Yadav and Chotey Yadav alias Kanhaiya Lal Murari have already been granted privilege of anticipatory bail by

Patna High Court Cr.Misc. No.38584 of 2016 (3) dt.11-11-2016 2/2 different Benches of this Court. Petitioner is in jail custody since 22.12.2015 and the investigation against him has already been completed.

Taking note of the aforesaid facts as well as to maintain the parity of justice, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Sessions Judge, Rosera, Samastipur in connection with Sessions trial no. 100 of 2016 arising out of Bithan P.S.Case No. 145 of 2013.
