2. The petitioner seeks bail in Bairgania P.S. Case No. 99 of 2024 registered for the offence punishable under Sections147, 149, 341, 448, 323, 324, 307, 379, 504, 506, 354 of the Indian Penal Code.

3. The allegation against the petitioner and co-accused is that they entered into the house of the informant and started abusing and assaulting them by means of country-made pistol, garasi, dab and iron rod, due to which they sustained injuries. It is further alleged that the petitioner also assaulted the informant's nephew by means of butt of the pistol, due to which, he sustained head injury.

4. It has been submitted on behalf of the petitioner that the specific allegation against the petitioner is that he assaulted Md. Shamshad Alam Ansari with the butt of the gun on his head and the injury on the persons of Md. Shamshad Alam Ansari are simple in nature. He further submits that the petitioner is a person of clean antecedent and he is under custody since 11.06.2024.

5. Learned APP has opposed the prayer for bail.

Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Bairgania P.S. Case No. 99 of 2024 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.
